These Terms of Service ("Terms") govern your access to and use of the NOVA PETS website, online store, products, services, and related content and features (collectively, the "Services").
The terms "NOVA PETS," "we," "us," and "our" refer to NOVA PETS.
By accessing, browsing, or using our Services, or by purchasing products from our store, you agree to be bound by these Terms of Service and our Privacy Policy.

Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.

If we cancel or modify an order after payment has been made, we will refund any amount charged for the canceled portion of the order using the original payment method, subject to applicable law.

Once an order has entered processing or fulfillment, we may not be able to accommodate cancellation requests.

Our estimated delivery time is generally 5–11 business days.
Delivery estimates are provided for informational purposes and are not guaranteed unless expressly stated otherwise.
Orders may be fulfilled and shipped from locations outside the United States, including China.
Shipping and delivery times may be affected by circumstances beyond our reasonable control, including:

- Weather;
- Customs or governmental processing;

Where appropriate, consult a qualified veterinarian or other animal-care professional regarding your pet's specific needs.
NOVA PETS is not responsible for injury, illness, property damage, or other loss resulting from misuse, improper installation, improper supervision, failure to follow product instructions, normal wear and tear, unauthorized modifications, or use of a product for a purpose for which it was not designed, except to the extent liability cannot lawfully be excluded.

All content included in or made available through our Services, including but not limited to:

- Logos;
- Brand names;
- Product names;
- Text;
- Graphics;
- Photographs;
- Product images;

is owned by NOVA PETS, its affiliates, licensors, or other respective owners and is protected by applicable intellectual property laws.
You may access and use our Services for personal and lawful purposes only.
You may not, without our prior written permission:
- Copy;
- Reproduce;
- Modify;
- Distribute;
- Republish;
- Sell;
- Create derivative works from;
- Publicly display;
- Publicly perform;
- Download or systematically store;
- Scrape; or
- Otherwise exploit
our content or intellectual property, except as expressly permitted by law.
Nothing in these Terms grants you ownership of or any license to NOVA PETS intellectual property except for the limited right to use our Services in accordance with these Terms.
All rights not expressly granted are reserved by NOVA PETS.
SECTION 10 – CUSTOMER REVIEWS AND FEEDBACK
If you submit reviews, comments, photographs, videos, testimonials, suggestions, ideas, or other content to NOVA PETS ("Feedback"), you grant NOVA PETS a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, distribute, display, and otherwise use that Feedback for lawful business purposes, including marketing and promotional purposes.
You represent and warrant that:
- You own or have the necessary rights to the Feedback you submit;
- Your Feedback does not violate the rights of another person or entity;
- Your Feedback does not contain unlawful, defamatory, abusive, obscene, or otherwise prohibited material; and
- Your Feedback does not contain malicious software or other harmful code.
We reserve the right, but not the obligation, to review, edit, restrict, or remove Feedback that we reasonably believe violates these Terms, applicable law, or the rights of others.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT:
- OUR WEBSITE WILL ALWAYS BE AVAILABLE;
- OUR SERVICES WILL BE UNINTERRUPTED;
- OUR SERVICES WILL BE ERROR-FREE;
- INFORMATION ON OUR WEBSITE WILL ALWAYS BE ACCURATE OR COMPLETE; OR
- OUR SERVICES WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SECTION 15 – LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOVA PETS AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND BUSINESS PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES OR PRODUCTS.
THIS MAY INCLUDE, TO THE EXTENT PERMITTED BY LAW:
- LOSS OF PROFITS;
- LOSS OF REVENUE;
- LOSS OF DATA;
- LOSS OF BUSINESS OPPORTUNITIES;
- BUSINESS INTERRUPTION;
- REPLACEMENT COSTS; OR
- OTHER INDIRECT OR CONSEQUENTIAL LOSSES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO YOUR PURCHASE OR USE OF OUR PRODUCTS OR SERVICES WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO NOVA PETS FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
SECTION 16 – INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless NOVA PETS and its owners, officers, directors, employees, affiliates, agents, contractors, service providers, licensors, and business partners from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising out of or related to:
- Your violation of these Terms;
- Your violation of applicable law;
- Your violation of the rights of another person or entity; or
- Your misuse of our Services or products.
We reserve the right to assume control of the defense of any matter for which you are required to indemnify us, and you agree to reasonably cooperate with such defense.
You will not settle an indemnifiable claim in a manner that imposes a non-monetary obligation on NOVA PETS without our prior written consent.
SECTION 17 – TERMINATION
We may suspend or terminate your access to our Services if we reasonably believe that you have violated these Terms or applicable law, or where otherwise permitted by applicable law.
You may stop using our Services at any time.
Termination will not affect rights or obligations that accrued before termination.
Any provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute-related provisions.
SECTION 18 – GOVERNING LAW
These Terms of Service and any dispute arising out of or relating to these Terms or your use of our Services will be governed by the laws applicable in the state in which NOVA PETS is legally organized and headquartered, without regard to conflict-of-law principles, except where applicable law requires otherwise.
To the extent permitted by applicable law, you and NOVA PETS agree that any legal action or proceeding arising from these Terms or your use of our Services will be brought in the appropriate state or federal courts located in or serving the jurisdiction in which NOVA PETS is headquartered.
Nothing in this section limits any rights or remedies that consumers may have under mandatory consumer-protection laws applicable to them.
SECTION 19 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will remain in full force and effect.
The invalidity or unenforceability of one provision will not affect the validity or enforceability of any other provision.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy, Refund and Return Policy, Shipping Policy, and any other policies referenced in these Terms, constitute the entire agreement between you and NOVA PETS regarding your use of our Services and supersede prior agreements, communications, or understandings relating to the same subject matter.
If any ambiguity exists in these Terms, it will not automatically be interpreted against the party that drafted the Terms.

You may not transfer, assign, or delegate these Terms or any rights or obligations under these Terms without our prior written consent.
NOVA PETS may assign or transfer these Terms, or its rights and obligations under these Terms, in connection with a merger, acquisition, sale of assets, reorganization, or similar business transaction, or as otherwise permitted by applicable law.

We may update or modify these Terms of Service from time to time.
When we make changes, we will update the "Last Updated" date at the beginning of these Terms.
If required by applicable law, we will provide additional notice of material changes.
Your continued use of our Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
